A) Surely you have travel insurance ? Can't the travel insurance company fix you up with a solicitor ? You could also try asking the British Embassy/Consulate in Brazil for advice.

My motor Insurance co. won't back me up after an accident that I believe wasn't my fault. Require help!

Q) The fully comp insurance covered legal expenses but now say after their investigation, (they didn't even check that parking on that road at the time is illegal)that if I choose to go to accident lawyers, I will be liable to pay everything. Details of accident were that I was joining a clear lane and somebody cruising a busy road overtook my witness's car on the left and joined lane beside mine. there was a parked car on his lane so he tried to squeeze btw the parked car and mine, therefore changing lanes and unable to stop in time. His car was written off, the parked car had the front h/lights and surrounding smashed and my car had slight dent and scratch as I had stopped in time. My witness hadn't seen the actual accident as he was further down the road at the time - my lane was clear at the time I tried to join it. Any suggestions?

A) The legal cover companies will only take on cases where they are guarranteed to win. Find out how much it will cost in legal fees to fight your case and compare it to how much you will lose from your insurance if you get them to pay for the damage. You may find that you will be better off not to pursue the matter. I know, you want justice to be served but sometimes you have to take a hit, it's unfair.

lawyer joke?

Q) A local United Way office realized that the organization had never received a donation from the town's most successful lawyer. The person in charge of contributions called him to persuade him to contribute. "Our research shows that out of a yearly income of at least $500,000, you give not a penny to charity. Wouldn't you like to give back to the community in some way?" The lawyer mulled this over for a moment and replied, "First, did your research also show that my mother is dying after a long illness, and has medical bills that are several times her annual income?" Embarrassed, the United Way rep mumbled, "Um ... no." The lawyer interrupts, "or that my brother, a disabled veteran, is blind and confined to a wheelchair?" The stricken United Way rep began to stammer out an apology, but was interrupted again. "or that my sister's husband died in a traffic accident," the lawyer's voice rising in indignation, "leaving her penniless with three children?!" The humiliated United Way rep, completely beaten, said simply, "I had no idea..." On a roll, the lawyer cut him off once again, "So if I don't give any money to them, why should I give any to you?"

A) Great jokes should always be starred, *****5 Stars

Charity Lawyer?

Q) A local charity office realized that it had never recieved a donation from the town's most succesful lawyer. The director called him, hoping to get a contribution. "Our research shows that out of a yearly income of at least $500,000, you've given not a penny to charity. Wouldn't you like to give back to the community in some way?" The lawyer replied, "First, did you research also that my mother is dying after a long illness, and has medical bills that are several times her annual income?" Emmbarresed, the director mumbled, "Um...no" "Or that my brother, a disabled veteran, is blind and confined to a wheelchair?" The stricken director began to stammer out an apology but was interupted. "Or that my sister's husband died in a car accident." the lawyers voice rising in indignation, leaving her penniless with three children?!" The humiliated director said simply, "I had no idea...." " So if I don't give any money to them, why the hell would I give it to you?"

A) Tight fisted lawyer. Could he be a relative of my mother in law? She squeaks when she walks, she's so tight!

Farmer Joes Accident?(Good if you can stay awake long enough to read it)?

Q) Farmer Joe decided his injuries from the accident were serious enough to take the trucking company (responsible for the accident) to court. In court the trucking companies fancy lawyer was questioning farmer Joe. "Didn't you say, at the scene of the accident, 'I'm fine'?" said the lawyer. Farmer Joe responded, "Well, I'll tell you what happened. I had just loaded my favourite mule Bessie into the......." "I didn't ask for any details," the lawyer interrupted, "just answer the question. Did you not say, at the scene of the accident, ā€œI’m fine?ā€ Farmer Joe said, "Well, I had just got Bessie into the trailer and I was driving down the road..." The lawyer interrupted again and said, "Judge, I am trying to establish the fact that, at the scene of the accident, this man told the Highway Patrolman on the scene that he was just fine. Now several weeks after the accident he is trying to sue my client. I believe he is a fraud. Please tell him to simply answer the question." By this time the Judge was fairly interested in Farmer Joe's answer and said to the lawyer, "I'd like to hear what he has to say about his favourite mule Bessie." Joe thanked the Judge and proceeded, "Well, as I was saying, I had just loaded Bessie, my favourite mule, into the trailer and was driving her down the highway when this huge semi-truck and trailer ran the stop sign and smacked my truck right in the side. I was thrown into one ditch and Bessie was thrown into the other. I was hurting real bad and didn't want to move. However, I could hear ole Bessie moaning and groaning. I knew she was in terrible shape just by her groans. Shortly after the accident a Highway Patrolman came on the scene. He could hear Bessie moaning and groaning so he went over to her. After he looked at her he took out his gun and shot her between the eyes. Then the Patrolman came across the road with his gun in his hand and looked at me. He said, "Your mule was in such bad shape I had to shoot her - how are you feeling?"

A) Very good. Reminds me of the same lawyer who was driving along the road when another car ran into him. Because he was wearing a seat-belt he wasn't badly hurt, just shaken. He jumped out of the wrecked vehicle and went across to see the driver of the other getting out too. He was surprised to see it was a priest. "Hell father," He said, "What were you doing? You've wrecked my car!" "I'm truly sorry my son." Said the priest, "A momentary lapse of concentration. Any way I've just called the police on my mobile phone, they'll be here shortly." And then looking deep into the lawyers' eyes continued. "You know son, you look terribly shaken. Here have a sip of brandy from my hip flask." "You're right father." Agreed the lawyer taking the flask and having a drink. "Oh, that's better." "Have some more son." Encouraged the priest. "In fact drink it all, I don't mind." The lawyer did as he was bid and on almost finishing the flask said. "That was great father. I've saved a mouthful for you. Here you are" handing the flask back to the priest. "Oh that's very kind of you my son." Said the priest, smiling, "But I think I'll have mine after the police have been.

Unhappy with Compensation Lawyer ???

Q) After having a whiplash injury from the car accident in September, I've had a lawyer company dealing with it, provided through my fully-comprehensive insurance by my car insurance provider, as a part of my policy. I'm getting the impression that this lawyer seems to be "scrutinise" me, rather than HELPING me & pointing me in the right direction as what to do, etc. in order to maximise the financial gain from the insurance company of other driver. Is it normal that such lawyer DO NOT help their client & they're ONLY interested in getting the case sorted out by whatsoever amount they manage to get, as a compensation, from the insurance company of other driver ??? If I'm NOT happy with her now OR not happy with the compensation amount she manage to get off the other insurance company's provider, is there an option THEN to find ANOTHER lawyer (perhaps, on "no win, no fee" basis) & let this new laywer redo the entire compensation process, AGAIN ???

A) it's his job to "scrutinize" you, he's trying to make sure it's rock solid that you should be given the money for this, because if you don't get paid, he can't charge more for helping you win

Claiming compensation for an accident at work?

Q) I fell from a step ladder at work while reaching for a box from some racking. The box tore open as I lifted it down spilling its contents onto me.This caused me to wobble and fall from the steps. I injured my wrist, tearing muscles and tendons. I have been off work for three weeks so far and my employer is only paying me 80% of my wage even though it was an accident at work. Everyone keeps on telling me to get a claim in, but I don't know if I actually have a case or how to even go about claiming. I've seen the ads on TV etc for Injury Lawyers for You etc, but don't really know if I should approach a company like this as I haven't actually done any long term damage. All I would like is full pay while I'm off work. Has any body had any similar experiences or got any good advise for me. Thanks.

A) Stephen O'Neill is dead right about those no-win no fee sharks you see on the telly. They are just claim farmers (i.e they just sell your case to a firm on their books). However, if you do go to a good 'no-win no-fee' solicitors firm [try the smaller ones like Pinto Potts - see their website] they should be able to get sufficient documents from the employer to see whether there's a case to run. The HSE route will not assist you, I'm afraid. The employer is obliged to report the accident on a RIDDOR form in any event (to the HSE). It's highly debatable whether the working at height regs will assist either - i think the case turns on the box that ripped. On the bare facts as set out, I don't see you can bring a valid claim. And I've been a lawyer for 15 years. You might have a claim, but it's not immediately apparent you have. It depends on a whole host of factors you couldn't possibly outline in a forum like this. You really need a good PI solicitor to look at the documents and sift through the facts. If you don't want my recommendation above, use someone that comes personally recommended. The ones Stephen O'Neill recommended are good too.

I'm going to sue the company?

Q) Is it just me, or am I being left behind in the 'law suits' department. Every time someone falls over in a Supermarket (because they didn't see the grape on the floor), trips over a paving slab in the street (because they weren't looking where they were going), falls out of a tree (where they shouldn't've been anyway), gets their hand caught in a swing door (because they were trying to hold it open for the bit of totty following them) or sliding off the table (during a Bier Feste dance), the first thing people seem to be doing these days, is reaching for their phone and calling the nearest accident lawyer. However stupid the accident, the only thing that concerns people is how much money they can claim for being stupid and getting hurt in the first place. Even 'He hurt my feelings'. Personally, I think it's all very pathetic, even though I could have put a few 'stupid' claims in of my own on many an occassion. Am I the only one who feels this way, or am I the stupid one?

A) I agree....I DIDN'T sue when an 18 yr. old 8 1/2 mo. pregnant girl made a left in fron of me. I had an eye witness who pulled over and told the cop it wasn't my fault, I could not have avioded it. The girl told the cop that the truck in front of her turned left so she did too- duh! The cop asked her if she knew that she should not turn unless the intersection was clear - she said yes - double duh! I spent months going for physical therapy for bulging disk. I'll always have to do phys. ter. exercises. Totaled my car. But I felt it was the right thing to do....am I stupid or what?
